Terms of Service

These terms govern your use of this website and the website design services offered by Andy McDonald, d/b/a RestDepot ("we", "us").

What we do

We design and build websites for restaurants for a one-time flat fee. The specifics of any project — scope, price, and timeline — are set out in a written service agreement signed by both parties. Those terms control if anything here conflicts with them.

Pricing

The restaurant website package is $599 USD, paid once. Submitting an order request does not charge you, complete a purchase, or transfer ownership. We contact you to confirm the scope, timeline and payment arrangements before work begins. The price and payment schedule agreed in your signed service agreement control your project.

There is no RestDepot subscription required to keep your website. Domain registration and renewals are separate from the $599 website fee and are paid by you directly to your chosen registrar. Hosting beyond provider allowances and optional third-party services may also have separate charges. We discuss these with you before you commit.

Your domain: costs, renewals and monitoring

You choose your domain name and extension, such as .com, .store, .xyz or another available extension. Your domain must be registered in your name and your own registrar account. We help connect it to the website, but the $599 website package does not include buying the domain or paying future renewals.

Registration and renewal prices depend on the registrar, extension, availability, registration term and whether the name is a premium domain. If a registrar offers a .com domain starting at $1 USD for the first year, that is introductory pricing subject to that registrar's eligibility rules and offer terms, not a guaranteed ongoing $1-per-year price. Renewals can cost more, and .store, .xyz and other extensions have their own rates. Check the full registration commitment, renewal price, taxes and additional fees before buying. RestDepot does not set or guarantee registrar prices.

You are responsible for paying all domain registration, renewal, transfer and any restoration fees, and for monitoring your domain's expiration date, renewal notices and account status. Keep your registrar contact details and payment method current, protect your account access, and verify that renewals succeed even if auto-renew is enabled. RestDepot does not pay for, renew or monitor your domain on your behalf. An expired domain can interrupt your website and email and may eventually become available to someone else.

Timelines

Our stated three-day build time runs from the date we receive all of your required content — menu, hours, photographs, and branding — and the agreed payment, with your design confirmed. Submitting a request does not start the build clock. We confirm your project schedule with you; delays in providing content extend the delivery date accordingly.

What we don't promise

We build websites. We do not guarantee any particular search engine ranking, amount of traffic, number of orders, or business outcome. Anyone who guarantees those things is not being straight with you.

We do not certify compliance with the ADA, WCAG, or any accessibility standard. We build to reasonable accessibility practices, but no website can be certified compliant.

Your content

You are responsible for the content you give us and you confirm you have the right to use it. If a third party claims your logo, photographs, or text infringe their rights, that's between you and them, and you agree to cover us for any resulting claim.

Ownership

After full payment, you own your completed website and control your domain. We complete the handoff with you: your finished website source files and assets, connection of your separately purchased domain in your account, hosting access, form and notification setup, and an account checklist with instructions. You can edit the site, move it, or work with another developer without a RestDepot subscription.

This handoff is completed by us after full payment; it is not automated by the request form. Account transfers may require your cooperation and the provider's transfer process. We retain our reusable template library and code framework, but provide the use rights needed to operate and modify your delivered website. Third-party assets and services, including photographs and fonts, remain subject to their original licenses and terms.

We may show your finished site in our portfolio and name your business as a client. Tell us in writing if you'd rather we didn't, and we won't.

Limitation of liability

To the maximum extent permitted by Colorado law, our total liability relating to our services will not exceed the amount you actually paid us. We are not liable for indirect or consequential losses, including lost profits or lost orders.

Third-party services

Websites we build rely on third-party providers for hosting, domain registration, and form delivery. We don't control those services and aren't responsible for their outages, pricing changes, or policy changes.

Governing law

These terms are governed by the laws of the State of Colorado.
